Purpose

This portal provides Parque Towers condominium unit owners with secure, digital access to association records. It enables residents and board members to search, browse, and review official HOA documents including board meeting minutes, financial statements, insurance policies, contracts, building documentation, and legal filings.

Florida Statute §718.111(12) -- Digital Records Requirement

Florida Condominium Act §718.111(12)(g), F.S.

Effective January 1, 2026, Florida law mandates that condominium associations with 25 or more units (excluding timeshare properties) maintain a password-protected website or downloadable application for posting official records to unit owners.

What the Law Requires

Under §718.111(12)(g), qualifying condominium associations must provide unit owners with digital access to specified official records through a secure, password-protected platform. The statute was enacted as part of Florida's ongoing modernization of condominium governance transparency requirements, recognizing that physical inspection of paper records at a designated office is insufficient for modern community management.

Exempt: Associations with fewer than 25 units, and associations that include timeshare units

Required Records

The statute specifies that the following categories of official records must be made available through the digital platform:

Declaration of Condominium The founding document establishing the condominium, including all amendments

Articles of Incorporation Corporate formation documents for the association entity

Bylaws Rules governing association operations, elections, and member rights

Rules and Regulations Adopted rules governing use, maintenance, and conduct within the condominium property

Board Meeting Minutes Written records of all board of directors meetings, including agendas and resolutions

Meeting Recordings Audio or video recordings of board meetings, where applicable

Annual Budget & Financial Reports Proposed and adopted budgets, financial statements, and reserve fund reports

Contracts & Agreements Service contracts, vendor agreements, and management company contracts currently in effect

Access & Credentials

The association is required to provide each unit owner with login credentials to access the password-protected website or application. Access must be limited to unit owners and authorized representatives. The platform must be maintained and kept current with records as they are created or amended.

Enforcement & Penalties

Failure to comply with the digital records requirement may expose the association to enforcement action by the Florida Division of Condominiums, Timeshares, and Mobile Homes (part of the Department of Business and Professional Regulation). Unit owners may also pursue remedies under §718.112 and §718.303 for denial of access to official records, including recovery of attorney's fees and costs.
